Breeding Contract
I hereby request a reservation for the Mare _____________________________________, registration association and number ___________________________________________, to the stallion, Wind In The Sky, for the 200____ season, on the following terms:
1. I agree to pay a non-refundable stud fee of $500.00 (includes a $250.00 booking fee). The $250.00 booking fee will accompany the return of this contract. The remaining $250.00 will be due when the foal stands and nurses. Make check payable to: THANKS A Lot Farm. Unpaid board, veterinary expenses, and any other expenses shall be paid before the Mare leaves the farm. For short-term care, the owner agrees to pay a board fee of $8.00 per day without foal, or $10.00 per day with foal at the mareÕs side. Board payments must be made at the beginning of each month of stay (based upon the arrival date of the mare). A late fee will be assessed for any board more than 30 days past due. Any veterinarian, farrier, foaling, extra feed or care requirement fees, etc., will be in addition and are due and must be paid before said Mare leaves THANKS A Lot Farm.
2. This breeding guarantees a live foal. A live foal is described a s a newborn foal that stands and nurses. If the foal is born dead, or should the Mare miscarry, abort or prove barren, after leaving BreederÕs premises, I have the privilege to return her for breeding during the following season. All rebreeds will not be charged a stud fee but are subject to the board fee.
3. I represent and warrant that the Mare to be bred is halter broken, is in sound breeding condition, has a recent uterine culture, is healthy, and is free from infectious, contagious, or transmissible disease. A current negative Coggins must accompany the Mare upon arrival at THANKS A Lot Farm. I understand that for my own protection, the Mare should be current on worming and vaccinations before arriving at the farm. If not, the BreederÕs veterinarian will examine and/or test the Mare at my expense. The Mare will be de-wormed with wormer of BreederÕs choice upon arrival at farm at the OwnerÕs expense. THANKS A Lot Farm reserves the right to refuse Mare if not in proper condition.
4. I agree that THANKS A Lot Farm, the Breeder, and any person associated with THANKS A Lot Farm, is not liable for death, sickness, accident and/or other harm, including consequential damages caused to the Mare and/or foal; and that I am liable for death, sickness, accident, and/or other harm, including consequential damages caused to the Stallion, and/or property, or persons associated with THANKS A Lot Farm.
5. If the Stallion should die, or become unfit for service before the Mare produces a live foal, or has not had the opportunity for a rebreed the following year, the stud fee shall be refunded to me by the Stallion owner within a reasonable time of receipt of a veterinarianÕs certificate stating that the Mare did not produce a live foal.
6. Until all outstanding debts are paid, I will not receive a breeding certificate, with the deadline being the end of the current calendar year. I also understand that all associations involved will be notified of the situation.
7. This contract is non-transferable. In the event that the Mare is sold or otherwise disposed of prior to the birth of the foal, the live foal guarantee will no longer be valid, unless specific written consent or assignment is given to me prior to transfer of ownership.
8. When THANKS A Lot Farm, or its authorized representative, signs and returns a copy of this contract to me, it becomes a binding contract of both parties, subject to the above terms and conditions.
I certify that I am the sole owner of the Mare or have authority to enter into this contract on behalf of the owner(s).
